Acceptance of These Terms
These Terms of Service (“Terms”) form a legal agreement between you and Edumento (“Edumento,” “we,” “us,” or “our”) regarding your access to and use of Edumento products and services.
By accessing or using Edumento, creating an account, accepting an invitation, or purchasing a paid service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
If you use Edumento on behalf of a school, academy, company, public body, or other organization, you confirm that you have authority to bind that organization to these Terms.
Eligibility and Children
Edumento provides services for children, parents, guardians, teachers, schools, academies and educational organizations.
A child may use Edumento only with the authorization and supervision required by applicable law. Authorization may be provided by a parent, legal guardian, school, teacher, academy or another legally authorized party.
A child may not independently purchase a subscription unless legally permitted. The adult or organization completing a purchase confirms that it has authority to authorize the child's use of the purchased service.
Parents, guardians and educational institutions are responsible for supervising children's use, maintaining appropriate account permissions, and informing Edumento if an account is being used without authorization.
Edumento Services
These Terms apply to all current and future Edumento services, including Edumento Kid, Parent, Teacher, School, Academy, Pet, websites, mobile applications, educational content, communications, reporting tools, learning paths, AI-powered features and related services.
Features may differ by country, device, account type, institution, subscription plan, age, grade level and availability.
Accounts and Security
Account information must be accurate, current and complete. You are responsible for protecting account credentials and for activity performed through your account, except where caused by Edumento's own security failure.
- Do not share passwords with unauthorized persons.
- Do not impersonate another person or create misleading accounts.
- Notify us promptly of suspected unauthorized access.
- Keep parent, child, teacher and institution account links accurate.
We may require identity, parental authority, institutional authority or payment verification before providing access or completing certain requests.
Schools, Academies and Teachers
Schools, academies, administrators and teachers are responsible for using Edumento lawfully and only for authorized educational purposes.
- Obtain legally required permissions or consents.
- Provide access only to authorized staff, students and parents.
- Maintain accurate classes, groups, attendance and educational records.
- Avoid entering unnecessary or excessively sensitive personal information.
- Remove access when a user leaves the institution or no longer requires it.
Educational institutions remain responsible for decisions they make based on information available through Edumento.
Acceptable Use
You must not use Edumento to:
- Break any law or violate another person's rights.
- Harass, threaten, exploit or endanger a child or another user.
- Upload unlawful, harmful, discriminatory or abusive material.
- Attempt unauthorized access to accounts, systems, APIs or data.
- Introduce malware, automated attacks or harmful code.
- Scrape, copy or extract data without written authorization.
- Reverse engineer or bypass access, subscription or security controls.
- Use AI features to generate harmful, illegal or deceptive material.
- Use Edumento for high-stakes professional decisions without qualified review.
We may investigate suspected misuse and take proportionate action to protect users, children, institutions, Edumento and the public.
User and Educational Content
Users may create or upload lessons, assignments, messages, images, documents, answers, assessments or other content (“User Content”). You retain ownership of your User Content.
You grant Edumento a limited, non-exclusive license to host, store, reproduce, process, display and transmit User Content only as reasonably necessary to provide, secure and improve the services.
You confirm that you have the rights and permissions necessary to upload the content and that it does not violate copyright, privacy, confidentiality or other legal obligations.
Artificial-Intelligence Features
Edumento may use AI to provide adaptive questions, explanations, learning paths, recommendations, reports, progress analysis and educational assistance.
AI-generated content is educational assistance and should be reviewed by an appropriate parent, teacher or qualified professional when necessary.
AI output does not constitute legal, medical, psychological, financial or other regulated professional advice. Edumento does not guarantee that an AI response, recommendation, forecast or classification is complete or correct.
Users should not enter highly sensitive information into AI features unless it is necessary and authorized for the educational activity.
Educational Reports and Results
Scores, recommendations, forecasts, progress reports and learning analyses are educational indicators. They are not guaranteed predictions and should not be the sole basis for important decisions about a child or student.
Teachers, parents, schools and academies remain responsible for reviewing educational information and exercising their own professional or parental judgment.
Payments and Freemius
Certain Edumento subscriptions, licenses, digital products or paid services may be sold and processed through Freemius, Inc. (“Freemius”).
For purchases processed through Freemius, Freemius acts as the authorized reseller and Merchant of Record. This means Freemius is the official seller responsible for payment processing, billing, invoices, applicable transaction taxes, payment authorization, fraud controls, chargebacks and certain refund administration.
The checkout will display the seller, final price, currency, billing period, applicable taxes and renewal conditions before payment is completed.
Purchases processed by Freemius are also subject to Freemius's applicable Terms of Sale and Privacy Policy presented or linked during checkout.
Edumento generally does not receive or store complete payment-card details. We may receive purchaser identity, product, transaction, subscription, invoice, country, payment status and entitlement information needed to activate access, provide support, prevent fraud and maintain records.
Subscriptions, Renewals and Cancellation
Recurring subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date, subject to the terms displayed at checkout.
By purchasing a recurring subscription, the purchaser authorizes Freemius and its payment providers to charge the selected payment method for each renewal.
Subscriptions may normally be managed through the Freemius customer portal or another account-management method made available by Edumento.
Cancellation prevents future renewals. Unless otherwise stated or required by law, cancellation does not automatically provide a refund and paid access normally continues until the end of the current billing period.
Failed or reversed payments may result in retries, payment notices, restricted access, suspension or termination of paid features.
Refunds
Refund eligibility is governed by the Refund and Cancellation Policy displayed by Edumento, the refund conditions configured for the product in Freemius, the checkout terms, Freemius's applicable Terms of Sale and mandatory consumer law.
A refund request does not guarantee approval. Where approved, refunds for Freemius transactions are normally returned through the original payment method and may be administered by Freemius.
Duplicate charges, unauthorized transactions and technical failure to provide a purchased service should be reported promptly to support@edumento.com.
Intellectual Property
Edumento and its licensors own the platform, software, interfaces, brands, designs, animations, characters, educational systems, original content and related intellectual property, excluding User Content and third-party materials.
We grant users a limited, personal, revocable, non-transferable and non-exclusive right to use Edumento for its intended educational purpose during the applicable account or subscription period.
Third-Party Services
Edumento may integrate hosting, analytics, AI, communications, payment, app-store and other third-party services. Those services may have separate terms and privacy policies.
Edumento is not responsible for third-party services outside our reasonable control, but this does not limit rights that cannot legally be excluded.
Service Availability and Changes
We may maintain, update, improve, replace or discontinue features. We do not guarantee uninterrupted or error-free access, compatibility with every device, or permanent availability of every feature.
Where a material change affects a paid subscription, we will provide notice when reasonably required by law or the applicable subscription terms.
Suspension and Termination
You may stop using Edumento at any time. Account deletion and subscription cancellation are separate actions unless explicitly stated otherwise.
We may restrict, suspend or terminate access where reasonably necessary for non-payment, security, legal compliance, child safety, serious misuse, repeated violations or protection of other users.
Disclaimers
To the maximum extent permitted by law, Edumento is provided on an “as is” and “as available” basis. We do not guarantee specific grades, learning outcomes, admissions, employment, certification or other results.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
Limitation of Liability
To the maximum extent permitted by applicable law, Edumento will not be liable for indirect, incidental, special, punitive or consequential loss, loss of profits, loss of opportunity or loss of data arising from use of the services.
Where liability cannot be excluded, Edumento's aggregate liability relating to a paid service will not exceed the amount paid for that service during the twelve months preceding the event giving rise to the claim, except where a different limitation is required by law.
These limitations do not apply to fraud, intentional misconduct, death or personal injury caused by negligence, or any liability that cannot legally be limited.
Indemnification
To the extent permitted by law, organizational users agree to defend and indemnify Edumento against third-party claims resulting from unlawful User Content, unauthorized institutional use, infringement of rights, or a material breach of these Terms.
This section does not apply to individual consumers where prohibited by law.
Governing Law and Disputes
These Terms are governed by the laws applicable to the legal entity operating Edumento, without limiting mandatory consumer rights available in the user's country of residence.
Before starting formal proceedings, users are encouraged to contact us so we can attempt to resolve the issue. The competent courts will be determined by applicable law and any mandatory consumer-jurisdiction rules.
Changes to These Terms
We may update these Terms to reflect changes in services, laws, technology or business practices. The updated version and effective date will be published on this page.
Where required, we will provide additional notice before material changes take effect. Continued use after the effective date constitutes acceptance where permitted by law.
